What's apples plan to get around this? I mean are they going to remove the sensor or just pay the crazy royalties. I find it interesting Canada is not involved in this and only the USA.

I kinda assumed it’s because the ITC only has jurisdiction within the US. They can block imports of the Apple Watch into the US, but can’t really do anything about other countries.
 
Well the CEO of Mosimo said he would settle with Apple if they approached him with an offer. They probably will come to a settlement agreement in the coming weeks. Apple will first try to experiment with this software work around Masimo’s patents. Apple has lots of patent Lawyers so we will see
And that's not buying them, that would be a licensing agreement...

That’s like asking why Canada gets DJI drones and Huawei phones and the U.S. doesn’t.
 
I’ll probably return my 9 that’s being delivered Sun coming from my 5 in mint condition I’ve had a few years. No way I’m going to be forced to buy and continue AC for just a simple battery replacement because no out of warranty service on 6-9. Someone took their 6 to Apple yesterday for a battery replacement on their 6 and was denied.

On one hand, I think that IP rights, and enforcement, are crucial to having a fair marketplace and allowing young entrepreneurs and smaller business to get their foot in the door...on the other hand, this is a medically significant piece of tech (both Masimo's and Apple's product), and I think that litigation over healthcare tech is a bit..."icky." I know the AW is a "nice-to-have" piece of tech with medical capabilities, and I am not sure I believe the blood oxygen detector is used in any way that is non-frivolous, but I still think that access to such tech should be made as widely available as possible--any healthcare company should be happy that there are more and more people with access to such devices, and want to work to ensure that a fair settlement is reached without pulling any medical features off of shelves.

It would be like if Volvo had patented the 3 point seatbelt.
 
I think some one suggested that Masimo are not just interested in licensing just the IP, but that they may be after a deal to supply hardware which would not work for Apple. If this is true this would make the whole issue much more complicated and it would not be just about money but the feasibility of integrating 3rd party hardware into the Watch, something that is unlikely to be possible given the highly integrated hardware in the Apple Watch.
That’s also about money.

Your 9 will have a year-long warranty. There’s no way this will take a year to get resolved. Why on earth do you think this would affect you?

Because I always keep my Apple Watches longer then the year warranty and as of now out of warranty won’t be serviced including batteries according to to Apple Store including 6-9 and ultra

Yep, because they don't technically do 'battery replacements' on watches, they are completely replaced but are imported in from China for stock.

I don't expect they will start to rip open these things for a battery, they can still send them back for refurbs for other markets in the meantime. So they will sit this out and let people know who put in a ticket when services are available again.

Again, that scenario is at least a year from now. This is not going to take a year to resolve.

It’s way too early to be freaking out about any of this.

I wonder about some final settlement makes Apple take out the O2 capability and app out of WatchOS, so all apple watches with the new OS version wont have that capability. I would be very ticked off if I had to buy something else, having spent so much recently on my U2.

Yet the bored board at Apple Inc HQ, see no issues, Tim will get his bonuses, and millions of shares, no worry Tim sleeps well at night.. Strange cause if you so much as leave a patty off a burger, you are fired.. Tim failed to ensure he had the rights to sell a product, and he is rewarded with more money than he could hope to spend in a lifetime.. Strange..

True, but what I meant to say is that it is not just about paying license fees but about hardware changes and a fundamental change in the way the Apple Watch is made. Integrating 3rd party hardware into the Watch, if that is what Masimo want, would be a very big deal. And yes that is about money but it is also about a fundamental design change in the Watch. Sorry should have been clearer.

Fun fact: I was a regular visitor to Huawei’s head office years ago (Canada). I asked several times if I could get one of their phones they had displayed in the reception area. They refused (to me anyway), also I should add the person that told this to me was a Huawei employee using a Blackberry. True!
 
Asthmatics, COPD sufferers, and anyone that has variations of the above, yet not bad enough to warrant something more clinical.

Also, it's not post covid by any definition, people still get it.

Omicron really does not go into the lungs anymore except for people compromised and again are better served buy the finger tip devices.

Not as portable and easy to keep track of. I addressed that in my post anyway..

Mine is actually fairly accurate compared to one of those consumer level finger testers. Ballpark and delta is a big indicator, and the Apple watch is perfect for that. At least for us marginal people.

Omicron isn't the only variant out there. If you think it's over, people still die from it and for that matter, the flu.
 
If anyone had come here two weeks ago and posted that the SP02 readings on the Apple watch 9 or Ultra 2 were way off and shouldn't be relied on as they are so far off the mark would have been slated beyond belief.

Not an Apple apologist, but this is none-the-less BS and much as I see everyone dumping on Apple the amounts Masimo is asking for far exceeds anything reasonable and comes across as petty for a tech that anyone could figure out re sampling of O2 using light detection. Makes me wish I could have "invented" a wheel then charged everyone for something that's round.
