I'm a shareholder too, and I want it settled rather than not being able to sell a successful product. My favorite Apple product for that matter...There's that saying, no pain no gain. Apple is taking risks here for sure, but who knows, maybe a year from now it will look like a brilliant move or a huge fail. Apple paying off Masimo might not sit will with the shareholders either.

I have no doubt that Apple licenses IP all the time from companies big and small. The reason they didn’t license Masimo’s patents is most likely that they firmly believe the patents have no merit. I think they will continue to try and prove that.
In the meantime, and assuming the above is true, the way Apple is letting this play out puts Masimo in a quite perilous position. This could end up very costly, even ruinous, for Masimo.
If Apple succeeds, which I think they believe they will, in getting all of Masimo’s claims invalidated some time later in 2024, Masimo will face a potentially massive claim for lost revenue from Apple due to the ITC ban. Masimo’s CEO’s surprise and dismay at Apple’s announcement to stop selling the watches tells the story, in my opinion.

True. That would mean Masimo would have a product available for sale. They state the SRP is the same as S9 or Ultra 2, with only software, refuses to post the OS, to be able to view the "health" data, you must pair it with some generic looking phone (user manual doesn't state anything), and no cell service, meaning paying more for less. Doesn't state anything about loading additional software. They are very cagey about this alleged watch. Makes me wonder how much (other than having the appearance of an apple watch) they took from Apple. If the sensor layout and functionality are exactly like Apple's, they will get sued as well.This is the most publicity Massimo will ever get...and then, it still doesn't /won't translate into sales for them. From what I've read, at least 5-10%, as well as used in workouts, etc healthwise. Many need it. It's the reason I waited for the 6 to come out, and why I upgraded to the Ultra 2Pay the company or disable the feature.

Not true. My father's team developed the first Pulse Ox. The Series 6 watch I had matches the pulse ox machines still in use at hospitals, as well as the Masimo finger devices used in hospitals and doctors offices. Not very inaccurate at all. We tested 6 different devices from medical supply shops, the 6 devices spanned 82-97, actual Pulse Ox on Watch and official machine was 94. Sorry bud. A discrepancy on a Masimo device that is off 12 percent isn't accurate.Apple watch has very inaccurate O2 sensor. She'd be much better of with a cheap (but accurate) fingertip sensor. Something like this.

He just turned 90, we went out looking for a good fingertip machine, compared 6 - ranged from 82-97.
