There's that saying, no pain no gain. Apple is taking risks here for sure, but who knows, maybe a year from now it will look like a brilliant move or a huge fail. Apple paying off Masimo might not sit will with the shareholders either.
I'm a shareholder too, and I want it settled rather than not being able to sell a successful product. My favorite Apple product for that matter...
 
One of the amusing things about Mac Rumours is the reaction to patents. If it’s a patent Apple has ignored then it’s stupid and people want the other companies dissolved over it. If another company infringes Apples patents (they have over 70k of them btw), well the system is right and others should respect the legal protection Apple has put in place. All very irrational and hypocritical indeed.

I have no doubt that Apple licenses IP all the time from companies big and small. The reason they didn’t license Masimo’s patents is most likely that they firmly believe the patents have no merit. I think they will continue to try and prove that.

In the meantime, and assuming the above is true, the way Apple is letting this play out puts Masimo in a quite perilous position. This could end up very costly, even ruinous, for Masimo.

If Apple succeeds, which I think they believe they will, in getting all of Masimo’s claims invalidated some time later in 2024, Masimo will face a potentially massive claim for lost revenue from Apple due to the ITC ban. Masimo’s CEO’s surprise and dismay at Apple’s announcement to stop selling the watches tells the story, in my opinion.

It's coming down to who will blink first.

It is worth noting that the reason Masimo - which is primarily in the medical grade products sector - decided to come up with its own version of a consumer grade smart watch is likely because they needed to do that to meet the "domestic industry" requirement of an ITC enforcement action. The ITC will not ban imports of products unless the patent owner is also in the business of making the patented product. And in Apple's motion for an interim stay, Apple claims that Masimo didn't meet the "domestic industry" requirement and even that a Masimo engineer testified that Masimo didn't have a product like the Apple Watch when Masimo originally filed their complaint with the ITC.

Does anyone rely on the blood oxygen sensor? I’d be fine if they just disable it and be done.
Yes, actually saved my life. My 91 year old father uses it as well (CHF). People at the gym use it. I don't know of that many people that don't use it.

Masimo would be foolish to release their own watch at this point.
True. It's about the same price as the S9 or Ultra 2, still not released for sale on their website, and who wants to pay the same price for Masimo's watch that has less features (ie, no cellular service. The description is really sketchy as well.
 
This is the most publicity Massimo will ever get...and then, it still doesn't /won't translate into sales for them. Smh haters, but its valid *shrug*
True. That would mean Masimo would have a product available for sale. They state the SRP is the same as S9 or Ultra 2, with only software, refuses to post the OS, to be able to view the "health" data, you must pair it with some generic looking phone (user manual doesn't state anything), and no cell service, meaning paying more for less. Doesn't state anything about loading additional software. They are very cagey about this alleged watch. Makes me wonder how much (other than having the appearance of an apple watch) they took from Apple. If the sensor layout and functionality are exactly like Apple's, they will get sued as well.

From what I've read, at least 5-10%, as well as used in workouts, etc healthwise. Many need it. It's the reason I waited for the 6 to come out, and why I upgraded to the Ultra 2
 
Apple watch has very inaccurate O2 sensor. She'd be much better of with a cheap (but accurate) fingertip sensor. Something like this.
Not true. My father's team developed the first Pulse Ox. The Series 6 watch I had matches the pulse ox machines still in use at hospitals, as well as the Masimo finger devices used in hospitals and doctors offices. Not very inaccurate at all. We tested 6 different devices from medical supply shops, the 6 devices spanned 82-97, actual Pulse Ox on Watch and official machine was 94. Sorry bud. A discrepancy on a Masimo device that is off 12 percent isn't accurate.

Bob's not giving accurate information, either. My father's work team built the original Pulse Ox (took up a small table). He also worked on the minaturization (fingertip) of it years later. He just turned 90, we went out looking for a good fingertip machine, compared 6 - ranged from 82-97. Actual check at a doctor's office, hospital and watch were all 94%.

Out of curiosity: do you know them to “innovate the sector”, or is your just an assumption based on one lucky patent ?

I know they innovate yes. Patents are not granted until there is a unique innovation that others are not doing. If this was ‘pending’, there would be a chance they are trying their luck, but they have patents granted, so are innovating within their Industry sector. This technology within this particular patent is being used in their product line too.
