So you should research this. It was a valid lawsuit. The story is super fascinating. People quote this as an example of a frivolous lawsuit it it’s really not. It was really influential in tort reform and led to some good stuff. She was late 70s and the coffee was almost 200 and required many surgeries to repair. The reason we hear this as an example of a frivolous lawsuit is largely due to McDonald’s and corporate media directing the narrative. I have 0 tolerance for asinine lawsuits but imo this was not one of them.
Yes, and from what I remember all she was asking for was enough to cover her medical bills, an extremely reasonable ask but McDonalds refused to budge and the jury ended up awarding her an obscene amount of money.

The emotional suffering from paying nearly a thousand dollars (even if you can get it back) for this subpar product. The motion sickness, nausea, vomiting, migraines; and a myriad of other symptoms. Some people may have missed time from work due to the symptoms and should be compensated for their lost wages as well as for the pain & suffering. It also affects peoples mental health having to reach a tough decision about whether to return this device, for myself it has caused sleepless nights. When people are sleep deprived they are functionally similar to somebody who has drank over the legal limit. People may start getting into car accidents due to this. Pilots who use this in portrait mode (as advertised) in the cockpit might get into a plane crash and die because of the jelly scrolling distorting the flight map. This is an iPad from hell.

This is precisely what happened! I watched a video some weeks ago on this particular suit; the woman was literally just a humble old lady, (somehow amazingly) not enraged by McD causing her so much physical/emotional pain and suffering—she literally just could not afford the hospital bills, and since they had directly caused them, she wanted help. They (as you said) wouldn’t budge, and she didn’t want to file a suit, but she had to. Jury saw what was happening and said “no, she deserves way more than just the medical bills from one of the biggest companies in the world.” Corporate greed can really bite you in the rear sometimes!

I’m compiling everything together to file a Class Action Lawsuit over this. If anyone wants to partake please comment with the issues this jelly scrolling has caused to your well being. Feel free to send me PM’s as well, if we’re able to win this we could make them fix the problem. I hope we one day get the mini 6 without this issue, and this is a way we can make it happen.
If you have admitted to knowing about the issue, while keeping your iPad past the return window, then I’m not sure what legal case you actually have.

Apple gives you 15 days to return the iPad, and yes you can get all of your money back, which is plenty of time for those people to return someone that afflicts them is such serious ways.

Um…. no.

You can’t sue for mental or emotional distress because you bought a product you don’t like. That is simply not a thing. Even if you could, you should have done your own research and read the countless articles before purchasing.

You can’t sue for something that “could have happened.” Sure, a plane could have crashed. Or a car could have driven unsafely. Or a clown could have hidden in your closet. None of that matters. You can only sue for things that actually did happen.

You would have to be an idiot to continue using a product that makes you lose sleep, become ill, or miss work. You have a responsibility under the law to mitigate your damages. In this case, that would mean you simply STOP using the product. Even if you could pursue this claim (which I don’t think you can), you would need comprehensive medical proof that it is the iPad causing all these problems.

I'm a newbie and haven't purchased the 'new' iPad mini as yet so not aware of this 'jelly rolling' capability. Do you have to pay more for it?

WHY should Mcdonalds budge? So every time somd idiot spills food on their clothes now Mcdonalds will have to pay to clean the clothes? If they spill water on their seat, should Mcdonalds pay to dry their car? Where does it end? OF COURSE Mcdonalds wasn't going to give in. It truly hate what our society has become. A bunch of entitled whiners that run and cry to mommy and daddy the minute they have to work for something or are inconvenienced in any way.

for someone complaining about entitled “whiners” these comments are very…ironic…but anyway. you realize she had to get literal skin grafts on her thighs right? and it was provable in court that mcd was making their coffee far hotter (to an unsafe degree) than any other fast-food chain? the things you learn in court are fun!

I also highly doubt her mommy and daddy were still around given that she was a 79-year-old woman with no money to pay for the 2 years of medical treatment she had to undergo ;)

she literally just wanted her medical bills paid for. she didn’t want a lawsuit. let’s bring it full circle here—I’ll wager there’s a fair amount of people who don’t wanna sue Apple for infringing on their patents, but Apple similarly does not budge! and it almost always ends with a settlement! just like this case did. (read: she was not awarded the millions that the jury decided on.)

Yeah and if it were his elderly mother or grandmother who was scalded due to their scorching coffee temperatures we all know he'd be singing a different tune; especially if he and his family had to cover the extensive medical costs.

I don’t know how old you are, but this wasn’t a LOL situation. She suffered third degree burns that required skin grafts. McD had been on notice of this before because its coffee had burned other patrons. McD was maintaining its coffee at a temp that was unnecessarily high, so that it quickly burned skin. Lowering the temp would have allowed more time for a patron to pull the wet clothing away from the skin and reduce the severity of the burns. So no, this wasn’t entirely her fault.

And OP, the law requires a plaintiff to mitigate damages. Apple provides a 15 day return window. If a product doesn’t meet your expectations, return it. You’ll get your money back and will have incurred no damages that could be awarded by a court.
