Technically and technologically, it is software still that drives the home button. A glitch could render even home buttons on older devices as powerless as the new capacitive ones.

So why did the Apple iOS developer's break it to start with? They sure could have prevented a lot of bad press had they done some adequate testing on the older devices before the release.
What's Apple's combined workforce across the world? It'd be dwarfed by the millions of users. They do it better than many others, but they can't possibly figure 100% of things. There will be use cases that they come across, and then they will act on it.
