OP, I'm not sure you can conisder this theft. It's a lost item. You don't know someone has it yet and you probably can't use the current suit as precedent because it's not yet over. That said, I'm real sorry this happened. Hopefully you can find a way to get reimbursed for it by way of insurance or something.

Well, we have been through this again and again. I suppose California law is not that much different from law in the other US states; according to California law taking a lost iPad and not returning it to the owner or the police is theft.

Theft? Am I missing something? You left it unattended in a public place, and you want to try to blame someone else? How about asking USAA or Apple if they have some sort of Dumb A$$ insurance, if so you will qualify.

You have a chance to get it back. They take months though. I left my dslr on Alaska and got it back. But it took awhile.

Absolutely. It's an abuse of the community here and he should be shunned. I'll be the first to hail him if it turns out to be true, but we all know this will end badly.

I am on the other side of this issue, I find no harm if it turns out to be "nefarious" (you must have insecurity problems to think you need to use words that everyone knows are hardly ever used in every day conversation, hope it makes you feel astute).

WTF? You must be kidding. I wasn't trying to use any big word. I just thought that the word happened to fit in this case. You must have some issues of your own if you get uptight about somebody using words that are with in their vocabulary.

People use words on forums all the time that I do not know. Instead of griping about it I search the word online and actually learn something. I will do my best in the future to dumb it down so you don't get offended.

I also do not get why you are on the other side of the issue? You think it is fine and dandy if people maliciously make posts with the intent to dash somebodies hopes? I really don't understand that. If the post is legit I am all for it. If it was done as a prank how can you support that?

Nefarious

Nefarious is a great word.

I use it all the time along with wicked, evil, egregious, heinous, atrocious, vile, foul, abominable, odious, depraved, monstrous, fiendish, diabolical, unspeakable, despicable; villainous, criminal, corrupt, illegal and unlawful.

I particularly like "Despicable." Reminds me of Daffy Duck.

Actually, it isn't necessary that the definition of "theft" under applicable criminal law be co-extensive with the definition as "theft" used in an insurance policy. An insurer is free to exclude from theft coverage property that has been misplaced or lost.

As for the left behind (not stolen) iPad, I feel for the guy who left it, but it is his fault.

The poster that made the "I found an iPad" thread, I just happen to find humor in the post.

Anybody over the age of 14 who doesn't know what "nefarious" means should consider suing their junior high school. It's not a rare or mysterious word. Wait ... is "mysterious" mysterious?
 
We need a way to track our ipads other than MobileMe (too costly and don't any other feature)

I found one app that could track the pad. However it won't work because I lock my pad. So, since the finder/thief can't actually use it the pad can't be tracked.
 
Ok, I have an update, the insurance company and police sided with me on the iPad being stolen because I made many efforts such as calling the baggage resolution line religiously and sending many emails to the device, the insurance company cut me a check and I now have a new iPad.
