I would. It should be packed better than you received it. Particularly if the seller resends it to you. :eek: So the better packing would help to prevent further damage.

UPS will treat it the same way as before. :p

BTW, have you had any recent response/success with PayPal/eBay with this?
 
Good choice!

Returning the damaged MP for a full refund is the way to go. If you can wait, new MP's with much faster technology and a faster OS (Snow Leopard) are due in early '09. With the economy the way it is, you could pick up a used or refurb current model for much less $$ and it will be PROPERLY packaged and shipped. Or wait and get the new faster model. I would avoid personal eBay purchases for any kind of used computer. EBay stores are usually a different story, as they know how to package and ship, and won't tolerate any unhappy customers, as their feedback means everything to them.

Hey buddy, I was just skimming over the last few pages and to be honest you have made the CORRECT decision. Put it this way, you're working on something in a month, have yet to get a backup drive and the hard drive or drives pack up! You loose everything. From my experience from when I was in I.T. if the optical drive has failed due to poor packaging and delivery get rid of the computer. You can end up out of pocket in 4 months. Hard drives are cheap yes but can you afford the time to reinstall everything and remake everything you lose?

As everyone has said, look carefully through the refund process with paypal and ebay, follow EVERYTHING to the letter and send the computer back with FULL records of every action you take. Make damn sure you send it back fully recorded requiring his signature upon receipt and make sure you have a full receipt too.
Then wait for the money and buy something like this and be happy:

Actually, I would be inclined to pack the original box in another box and have it packed by UPS. That way, they can see what the original box went through. Also, insure it. Don't ever ship something expensive uninsured.

The warranty is for manufacturing defects, it's not insurance.

People who think like that are the same kinds who show up to the car dealership and say "I drove into a tree because I was drunk. Is that covered under warranty?"


yes it is for maufacturing defects but apple limited warratny does cover shipping damge if the item was bought at an apple retail store or certified reseller but in this case it wanst the 2 of them so you will have to go your own way

The iMac 2.8 is what I was thinking of getting, however, if I can come up with the extra money, I would much rather go with the 3.06.

If you're mind is made up on the iMac (or even something else), go for the refund. The hassle over this is getting to be more than the eBay Mac Pro is worth. Even if the seller/UPS would cover the repair parts, as the $350(?) amount wouldn't cover the labor. :(

Don't let this guy/PayPal... push you around. But as a previous poster wrote, make sure to keep any and all records. ;)

That's what I'm doing. I'm shipping the Mac Pro back tomorrow.
 
Am I to take it congratulations are in order? Looking at your sig your stating you have a nice iMac 2.8. Did you get it already? How are you finding it?

I wish I had a link to the auction page before saying this, but I believe this was a bad fix to start with. $1550 for a Mac Pro with those specs?!

If I had come across it, that would have been a red flag. Even if pictures were posted, they could have been old photos or something, but again, I can't find the auction page.

Glad to here it has been resolved though!
 
..and the dispute goes on...

The seller wanted the refund back, due to the fact that I initiated a claim with UPS for $350 when I had the Mac Pro, I returned it, and he said, after he got it, that he went to the Apple Store and said the repairs would cost $1000 for them to do it. So, he wanted the refund back until the updated claim (now for $1000) is resolved with UPS. So, now he has the computer, and he wants me to wait for the refund until UPS gives him back the money. Here's what he says:

1) You initiated the UPS claim, informing me that your repair
cost from the Apple Store would be $300. You said nothing
about this being just the cost for you to purchase a new case.
Initiating the claim intimated at least some intent to keep the
computer. Just because you decided you wanted an iMac instead
doesn't give you a good reason to change your mind several
weeks later.

2) Because you initiated the UPS claim, the refund still has a
great deal to do with you. Until it is completed, you're still
involved in its resolution.

3) Right now, I consider you to be at fault for any difference
between the damages awarded by UPS and the actual repair cost.
Lying about the repair cost has made things considerably more
difficult, which should be at your expense.

4) The highest estimate I've received for the case replacement is
$1,000. The difference between this and your "estimate" is
$700. If you need the money right away, I can give you $850
($1550 - $700), and hold the rest until the UPS claim is
resolved. I simply don't see how you can expect a full refund
until the extent of your false repair estimate is determined.

5) There is no such thing as PayPal siding against UPS. The
insurance claim has to do with UPS directly - you should know
this, you initiated it. PayPal has absolutely no involvement in
anything aside from the financial transaction between the buyer
and the seller.

Does he have a valid claim? I thought as the shipper only he has access to the claim and the monies and can get the check. Shouldn't he be able to call up and specify what is exactly wrong and change the claim.

You as the buyer should not have to deal with this. I hope you paid with a credit card and would start some sort of dispute.

I don't see why the shipping company wouldn't let him change the dispute or let you change it. I mean you could say the store found more stuff wrong with it when they opened it.
 
Stop talking on here and speak to PayPal, if you used PayPal your covered. Speak to them, do it. And keep in very good contact with the seller. If UPS tell U to **** then make a claim through PayPal for your money back as it is NOT YOUR FAULT. It is the sellers AND UPS's fault.



You had your answer a month ago. Did you get the refund or not?

You seemed to say you had it already, I HOPE you weren't silly enough to refund the refund.

If you filed a dispute with Paypal...you would be out of this already.

You have made a simple thing into a mess.

Get your money back and WALK AWAY. It's his problem, and should have been from square one.
