As much as I understand here, you returned the computer the way you received it? (well shipped it better id imagine).

He received the computer; then you should have your full refund and that should be the end of it.

it doesnt matter how much repair costs are, you paid X amount and you should be getting the full amount of X, not Y or Z etc etc.

Whatever UPS gives you should be balanced for the money spent on shipping the item back to the seller.

I figure they may cut a portion towards the seller for their shipping costs and coverage as well.

the seller atleast needs to reimburse you towards the amount you paid total on the auction.

something is a bit fishy with this guy, document all these towards paypal first and foremost, as well with eBay.
copy headers, email transaction, screenshots, whatever helps.

Does he have a valid claim? I thought as the shipper only he has access to the claim and the monies and can get the check. Shouldn't he be able to call up and specify what is exactly wrong and change the claim.

You as the buyer should not have to deal with this. I hope you paid with a credit card and would start some sort of dispute.

I don't see why the shipping company wouldn't let him change the dispute or let you change it. I mean you could say the store found more stuff wrong with it when they opened it.

He says that they sent him paperwork through mail (?) and he updated the claim 4 days ago. I tried calling UPS and they said that all the seller had to do was call them.

You had your answer a month ago. Did you get the refund or not?

You seemed to say you had it already, I HOPE you weren't silly enough to refund the refund.

If you filed a dispute with Paypal...you would be out of this already.

You have made a simple thing into a mess.

Get your money back and WALK AWAY. It's his problem, and should have been from square one.

What I meant to say was I thought the refund had gone in. He got the computer, found the new claim to be $1000, and never gave me a refund. I had a claim with paypal, but it expired 5 days ago. I searched all over for a way to renew it but apparently there is no way.

That's what I thought. But he says no, it's still my problem since I gave him the "wrong" claim amount originally. I don't understand why he doesn't just leave the claim at $350 and fix it himself.

Looks like he's trying to stall you and after an amount of time, there's nothing you can do. He's got the computer now and your money still. What's the link to the auction? This seems like a seller you'd want to avoid. Just one hassle after another.... Good luck though and stay strong and on top of everything. Ask him why he didn't call UPS when he just sent the stuff in the mail? Besides, you didn't lie about the cost to get it fixed, I thought you told him that's what it costs to buy another case, not including the installation because you'd do that yourself. If anything he misunderstood you and that's his fault.

Something just doesn't sound right about this whole transaction.

So, do you have any recourse left besides dealing directly with the seller?
CC,...?

Good luck, and I hope you manage to get it resolved, sooner rather than later.

I don't have a link to the auction because I am on my iPhone right now. The estimate was from me going to the store and just asking them how much a case would cost, without them repairing it.

The only thing I had was the dispute with paypal. I did pay with a credit card through paypal though...

First, it's :

When you say paid through a credit card... do you mean like funded PayPal through a credit card to pay for the computer? If so, then no, I got all of the money for it by selling things on eBay.

OK Dude, which is it?

Are you just posting whatever comes into your head now?

And Paypal Disputes don't just "Expire" unless you don't file them or they are baseless.

Either tell the truth or quit asking for people's opinion when you don't give them all the facts.

I am getting the VERY strong impression that you aren't being CLOSE to honest with us...or anyone.

There is just one truth....not multiple versions depending on who you are talking to.

Yeah, I can see that. :( Well, looks like I'm either going to have to live with the case as it is, or buy a whole new case and replace the old one. Where can I buy a new case? eBay only had one.

i don't necessarily think you should go back to ebay to look for another product where you just got one and were unsatisfied. i would call Apple, tell them the deal, and ask about replacing the case.

Sorry... I was thinking of something else... I payed for $462 of it through my bank account, and the rest through stuff sold on eBay, here's a screenshot of PayPal if you don't believe me...

And yes, disputes do expire, or in their terms, "time out"... Screenshot here.

Do NOT send any money back to him! It's the sellers fault for not packing it correctly, call paypal and have the dispute reopened, do not further delay. Tell the seller about your UPS correspondence.

What's his feedback?

I never had money in the first place. I'll try to get it reopened, but on their Help page, it says that once it's closed, it can never be reopened. The seller is the one "corresponding" with UPS.

This is what I just sent him in response:

Why didn't you just leave the claim at $350, and repair it yourself? Sorry to sound harsh, but it seems unnecessary to go through Apple when you can fix it yourself for much cheaper. It seems like it would be much less of a hassle for both you and I if you did that. I also replaced the DVD DL drive before I sent it off so that works now, so that's one less thing to fix.

I also talked with the Apple people and they basically said that "Without seeing the computer we can't tell you how much it would cost." I asked her if it was possible to buy the case itself and not the repair, and she said I could, but she couldn't give me a cost, but said it would be "considerably cheaper than $800". Her name was Danielle, at the Glendale Arrowhead Apple Store (623-707-2860) if you want to confirm this.

Good?

That's nonsense; have you ever gutted an MP completely and put it in a different case ? It's super easy, right ? Right...

And what busines did you have getting in touch with UPS in the first place, and tell them some silly low number re. the repair costs ?
Now the seller needs to try a lot harder to squeeze proper compensation out of UPS.

For a claim, you need to get an estimate from a certified repair center, period.
Why would the seller or anyone give a damn about what some Danielle told you, or what sort of cheap cases you might have found on the net ?
Well, UPS does, as the figure is in their system, and assumably way lower than the insurance they provide.
According to the auction site, insurance was included.

And still there is no evidence at all that the seller did a poor job packaging the computer, none.

This affair reeks of utter ignorance, and a little fishy, too.

Yes, I have actually, and in one of his first messages to me I asked how good he was with computers, and he said he was very good, so I assumed he could do it if I could.

The reason I mentioned her is because in one of his earlier messages he asked for the name of the person who I spoke to, as he wanted to speak to them himself. So I told him.

And I didn't take pictures of the actual computer in the box because it wasn't until I took it out that I noticed the damage... but I have pictures of all of the materials and boxes used, and the damage.

Thats a good idea. I had an item that was never shipped to me that I bought on eBay. PayPal was able to handle it, but it took over 1 month to process the refund.

Our seller says...

So, now you're saying that you altered the machine before sending it back to me? Now I'm certainly not going to issue a refund until a professional inspects the machine fully. The purpose of filing an insurance claim is to recover the cost of returning the damaged equipment to its original condition, not to buy a replacement part and do it yourself. I am not an Apple repair expert, and don't believe I would do as good of a job as one would. Therefore, I don't think that it makes sense for me to do it when the money available for the repairs should not be the issue. You specifically told me that you "went to the Apple Store and they told me that to repair it through them, the repairs would be $300". You lied. I'm not going to cut corners because of your mistake. I want the computer repaired by someone who is trained to do so, and that means it's going to cost somewhere in the neighborhood of $1,000. You calling an Apple Store _now_ and asking how much it would cost to do it myself doesn't help anything.

I replaced the drive with a brand new one, partially for my benefit, and then I left it in there when I sent it back to him so he wouldn't repair it.

I didn't say that I went to an Apple store and got the cost for them to repair the damages, I got the cost of a case. This is what I said originally about the estimate:

I just went to the Apple Store and they told me that to repair it through them, the repairs would be $300, and I asked for some sort of document stating that, and they said that to get any sort of document from them I would have to initiate the repair through them, which I obviously can't do.

I admit, I did get myself into some s**t when I said I went to the Apple store originally, but I assumed (yeah, makes an ass of u and me) that they could just sell me the case from them, which I found out, they can. So I was correct there. But therein lies the problem that I never /did/ go to the Apple store originally. So, it is partially my fault, I admit.

However, I still don't see why he would bother with the hassle of trying to get more money out of UPS. But, I don't know. Who's at fault here?

He has no one else left to get money out of. Either he gets UPS to fix it, or he's stuck with a broken Mac Pro.

Either way, it's not your problem. Get your money back. Let him deal with UPS.

This entire thing is fishy. No one sells a Mac Pro that cheap, and then packs it so poorly.

Whatever he's trying to pull on you, it's not your problem. Just get the money back.

The drive shouldn't be a huge deal, that's a user replaceable part.

Don't even think about doing the case replacement yourself. It's extremely likely that you'll break something, and Apple isn't going to want to touch it afterwards for any reason whatsoever.

I think you may need to re-dispute this via paypal.

give them tracking information that you sent the Macpro BACK to the seller, say you are requesting your full amount back and the seller has yet to reimburse you your money that spent on the machine itself.
detail as much as possible regarding the fact the seller sent you a damaged - NOT AS DESCRIBED item and continue to pursue it that way.

any contact between you and the seller, definitely document with towards PayPal and eBay.
I think IIRC in ebay a way to submit a notice or claim in there as well, atleast to report the member; which should flag it.

talk with your credit card company too just in case.

Okay, I'll call PayPal later today and ask them to reopen the dispute.

I hate to say it though you probably lost your cash here. Your only route left is PayPal ASAP. If I were him and wanted to make sure I didn't lose my money, I'd make a withdraw which was probably already done, remove my CC, and remove my bank account.

Did you just claim you replaced the case of a Mac Pro before ?

From your first post:

What should I do? How do I fix it?

Oh come on...

What I meant by that was that yes, I have replaced a Mac Pro case (I work part-time at Macmedia), but I was unsure on how to fix the dents in the old case.

Did you send it back with a larger or smaller drive?

If you sent it back with a larger drive, he is blowing smoke up your ass.

However, he can still drag his feet and ask for the original drive back, and ship you the other one back to you.

---

If he demands to take the machine to the Apple Store for a drive swap, he is insane. And I can see it happening for some reason.
