The answer...

Yes it is there momentarily.

But...

On pre-release software the menu option was available to assign it to a long press of the back button, however due to a bug in the retail software the menu option has been removed even though in the instruction manual tells you that its there.

So What happened?

Some digging by models looking into the official roms from HTC have discovered that on pre-release software a simple Model Identifier is in place to allow the menu option, but it looks for the pre-release model iD and not the retail iD which changed slightly. Simply changing this model iD puts it back and that's how the rom makers have put it back.

It appears to be an oversight, bug and should be restored in the next software update. Until then yes the pesky menu is there in some applications. However in most applications it isn't but that's no consolation.

So what does that mean ?

If you flash a rom you can get rid of it now, otherwise we'll likely be waiting until HTC roll out the 4.2.2 update they said would appear a month or two after launch.

Ah i see.

Thanks for restoring my faith in the One again lol.

Did you get it yet?

Has anyone received theirs yet? Got pics? Can you do a speedtest? first impressions?
Thinking of getting one at the AT&T store....

Well, here's an additional update (courtesy of AC) and the supposed reason why there is a delay with the unlocked 32GB and 64GB Dev editions:

Call me skeptical but why would the security issues surrounding the terrible incident in Boston and flooding in the midwest affect these shipments but all the carriers are getting theirs on schedule?

Ahh ok - i read in that article that the "free" cases were delayed - didn't know what type or pre-order or purchase triggered a free case.

Not that I want one - quite frankly, I won't use a case when I eventually get my HTC One (September).

If you're curious, I bought this case off Etsy for my One. There are many other nice options on the site. :)

If that's truly the case, then that'se excusable, for sure.

disagree

The original evo is still in people's hand today with no case so it's pretty durable but yes the charging port crapped out many times and that was a htc flaw but durable, the phone was damn durable.

Yeah its durable, but i can't call anything with a charging port that breaks so easily "good build quality"

Most people mistake build quality with build materials anyway.

It's clear the carriers got priority. There's no indication of delays with the carrier versions.

If HTC can't keep their own house in order, what faith can be restored? :T

The dev edition handsets may be shipping from different warehouses / distribution centre than the carrier handsets which probably went through a different channel.

I emailed HTC asking for some sort of compensation for this delay as it causes considerable inconvenience for me.

Maybe a free double dip case which wasn't offered to me.

Just got back from playing around with One. Man, it's a beauty. Feels nice in the hand and screen is beautiful. If only HTC would ship the phone already.
The phone at Att store did not have Google now enable. Where do you turn it on?

I know I have given you some major crap over the last couple of days, and some of it was not warranted. Could you please give use a better review of the HTC One than some of these iOS user that never wanted to like the phone. I was in the wrong for a lot of what I said before. I still stand by the nexus 4 being a really good phone, but that is over.

Woohoo I got a free case added to my order to make up for the delay. :D

Dojo, I def. recommend emailing or calling to get that free overnight. It might have even changed to that automatically.

You can count on it.

BTW my order now says estimated availability "Unknown."

That is not reassuring.

I would make sure return policy is clear and then try the One and return it if you don't like it.

I forgot to say is the following:
Please use the phone for more than a few hours. I see that some people are returning the phone after they have used it a few hours. If it were me I would return on the 10th day or so. Do not wait till last-minute either...

Do a google voice search and hit the menu button and settings, enable google now.

Probably because they are ammending your order so delivery time is not refreshed.

What am I swiss cheese ? All the stuff I've posted and photos I've done for you all counts for nothing :(

;)

Alright let me try it. I got email about delay saying free overnight but I still don't see that on the invoice.

Are you able to put setting toggles in the pull down notification area? I'm not sure it's Sense skin but I thought JB has setting toggles? I was able to put is as widgets but not in pull down.

I think that feature was introduced in 4.2 upwards, so you'll get that when HTC updates.

I actually use an app called settings extended that put the toggle widgets into the notification area.

But yeah pull down expanded info stuff I believe requires 4.2+

FWIW, mine also says Unknown. Not reassuring but probably the most truthful update. And I'm not going to bother calling as I prefer to use my phones naked and already have overnight shipping.

Really had to fight the urge to call LetsTalk and cancel and pick one up at my local AT&T. Real progress for me to not forgo the advantages that come with a bit of patience (i.e. no AT&T bloat, no reliance on carrier for updates) just to have the shiny new toy today. ;)
